the engine seized today when i was driving down the freeway. is it their fault or should i have done something before now? the paper wok says the oil got changed at the dealership around a month ago. should they have checked it before I drove it off the lot? this sucks!I bought a used car from the dealership less than a month ago and it had no oil in it.?
Anytime a used car is bought the fluid levels should be checked daily for the first few weeks until you see if any is being used or leaking, Sorry it is your responsibility. Even if you had a warranty it would not be covered for that reasonI bought a used car from the dealership less than a month ago and it had no oil in it.?
Unless the drain plug fell out, or the filter came off due to negligence by their mechanics during the oil change, I'm afraid you're out of luck. You can't hop in an old car that you don't know and expect NOT to have to check the oil and other fluids often. You should have seen a warning light before the engine was damaged. If you ignored it, it's your fault.
There is more wrong with the car,,there needs to be an indicator,by the way.If it was not an ';as is'; deal and if there was no warning by way of an indicator, light or guage, they will come good for it. If the indicator works then I'm sorry to say you are at fault.Hope the indicator doesn't work for your sake.
good luck.You need it.
~ You drove a month and never looked at the dipstick?
~ You drove a month and ignored the warning light or oil pressure guage?
~ Worst of all, you didn't look under the hood when the engine started making clattering sounds long before it seized, in plenty of time to put oil in before any damage was done?
Yes, it sucks, but you should have prevented it. Checking oil, coolant, brake fluid, transmission fluid, windshield washer fluid, tire pressure, etc are all maintenance checks that have to be done by the driver.
You should check your oil every time you put gas in the car. You could try talking to the dealer, but don't expect much help. It seems as if used car lots change their names every few months, to hide the fact that they sell a lot of overpriced junk.
If it had no oil in it a month ago it would not have driven off the lot and to your home. Your failure to check the oil is your problem. Most engines will not run more than several minutes without oil. Did you not see a warning light come on? Did you not hear a knocking noise? or was the radio to loud? You can try and blame them , but most people that buy a used vehicle check the oil when the get gas just to be sure it is not using oil, Then you would have something to fight back with
you should have checked your own oil especialy in a used car
It could be both of yalls fault. Whenever you buy a car from a dealership you shoud always let someone else look at it frist. But even before you leave the lot you should always check things like that. Do you have some type of time frame in case anything happens you can take it back or they can fix it for free? If so, look into that.
If the absence of oil was a defect in the car, such as a leak you had no reason to notice, or the car was burning oil, then you may be protected by your State's used car Lemon Law. And certainly you could assume they had put proper oil in it - I would suggest it is their responsibility if they failed to do that. Google your State Lemon Law. Notify the dealer in writing right away - as used cars often have only a 30 day warranty. In NY the Lemon Law does not apply if the car has over 100,000 at the sale date. You are under 30 days but I don't know the mileage or your State. Preserve your rights. Argue, and if there is enough money on the line, maybe even consult an attorney. Some States provide for attorneys fees as part of the Lemon Law for successful cases. And many attorneys will handle cases on contingency - that is - they take a percentage of the winnings or settlement, but get nothing if the case is not successful. If this is a questionable case, it may have settlement value with good negotiation. Good luck!!!!
